ANDREW PHILLIPS
LAST WILL AND TESTAMENT
In the name of God amen I Andrew Philips of the County of Union and
state of Kentucky having thought fit to make and do hereby make this my
last will and Testament while in the possession of my mental faculties
revoking all and every other wills, Testaments or Councils, heretofore
made by me and dispose of the whole of the property and money that I may
be in the possession or entittled to either in land or equity at my
death - in manner and form following (towit)
1st. I will and bequeath to my beloved wife Ester the whole of my
home farm including the mantion house with one years
prevision with what of my household kitchen and farming utinsels (untill
my son Lee Andrew arrives at the age of twenty one years
of age then if he wishes to settle himself on the part of the farm I
purchased of Daniel Morrow with part of the old tract adjorning)
and stock that may be necessary to carry on the farm also my negro boys
Davy and Thomas and negro girl Rachel during her natural
life or widowhood and at her death death the property with the interest
of the slaves to return to my estate and to be divided between
my three younger children the foregoing bequeath to my beloved wife is
made that she may have a comfortable support and that she
may the better able to keep my three younger children until they arrive
at the age to provide and take care of themselves.
2nd. To my grandson Andrew Johnston son of my deceased daughter
Sally wife of James Johnston I will and bequeath one dollar
in additiion to what I have heretofore given to his father and mother
and that my Executors pay the same; having heretofore given to
his father and mother and that my Executors pay the same having
heretofore given them their slave of my estate.
3rd. To my daughter Angey wife of Benjamin Johnston I will and
bequeath one dollar to be paid by my Executors having
heretofore given to them all that I intend they shall have of my estate.
4th. To my daughter Thaney wife of Alexander Ramsey I will one
hundred dollars in addition to what I have heretofore given
them which is all that I intend they shall have of my estate, but to
their son Andrew Ramsey I will and bequeath two hundred dollars
dollars to be paid to him by my executors when he arrives to the age of
twenty one years.
5th. To my daughter Amelia wife of James Wilson I give and bequeath
one negro girl named Jenney now in their possession in
addition to what I have heretofore given to them which is all that I
intend they shall have of my estate but to their son Andrew
Wilson I will and bequeath two hundred dollars to be paid by my
executors at the time of his arriving at the age of twenty one years
of age.
6th. To my son Edmond Philips. I will and bequeath the ballance of
the tract of land purchased of B. Wise and the tract
purchased of Wm Blackwell and the tract patented in my own name. The
three tracts lying adjorning each other on the Crab orchard
Creek and its branches also one negro boy named Dale to him and his
heirs forever.
7th. To my son Lee Andrew Philips I will and bequeath the tract of
land I now live on including the tract I purchased of Daniel
Morrow subject to the devise heretofore made to my beloved wife also one
negro boy named Bird to him and his heirs forever.
8th. To my daughter Elizabeth wife of Richard Parker I will and
bequeath Eight hundred dollars in addition to what I have
heretofore given to them to be paid by my Executors.
9th. my will and desire is that all the negros that I may have at
my death except those that I have already devised with the surplus
on the plantation with the debts that may be owing to me with what money
that may be on hand is to be equally divided between Lee
Andrew, Marion, and Margett Jane Philips enjoyning on executors to
expend sufficient of the interest and time to give to my three
last mentioned children a good English Education.
10th. It is my will and desire that my faithful slave Davy shall
be free from and after the death of my beloved wife.
11th. I do hereby appoint my beloved wife Ester Philips my
Executive and Hiram McElvy my executive and should it be that the
Court not act in that case I wish the county Court to choose for me such
and in their judgement they may decide compatant to do the
business with justice and honesty to the business.
